B\u00f6lge m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce tescili yap\u0131lan bu i\u015f yerine ait belgeler, gerekti\u011finde i\u015f m\u00fcfetti\u015flerince incelenecek. \u0130nceleme sonucunda muvazaal\u0131 i\u015flemin tespiti halinde, bu tespite ili\u015fkin gerek\u00e7eli m\u00fcfetti\u015f raporu, i\u015fverene tebli\u011f edilecek. i\u015fveren, bu rapora, tebli\u011f tarihinden itibaren 6 i\u015f g\u00fcn\u00fc i\u00e7inde yetkili i\u015f mahkemesine itiraz edebilecek. itiraz \u00fczerine verilen kararlar, kesin say\u0131lacak. E\u011fer itiraz edilmemi\u015f veya mahkeme, muvazaal\u0131 i\u015flemin tespitini onam\u0131\u015fsa, tescil iptal edilecek. Alt i\u015fverenin i\u015f\u00e7ileri, ba\u015flang\u0131\u00e7tan itibaren as\u0131l i\u015fverenin i\u015f\u00e7ileri say\u0131lacak.<\/p>\n<p><strong>\u00d6z\u00fcrl\u00fc \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu <\/strong><\/p>\n<p>D\u00fczenlemeyle \u0130\u015f Kanunundaki \u00f6z\u00fcrl\u00fc, eski h\u00fck\u00fcml\u00fc ve ter\u00f6r ma\u011fdurlann\u0131n \u00e7al\u0131\u015ft\u0131r\u0131lma zorunlulu\u011f&#8217;una da yeni d\u00fczenleme getirilerek, eski h\u00fck\u00fcml\u00fc ve ter\u00f6r ma\u011fdurlar\u0131 i\u00e7in i\u015fverene getirilen zorunlu istihdam kald\u0131r\u0131ld\u0131.<\/p>\n<p>\u00d6zel sekt\u00f6rde daha \u00f6nce i\u015f\u00e7i say\u0131s\u0131n\u0131n y\u00fczde 6 oran\u0131nda \u00f6z\u00fcrl\u00fc \u00e7al\u0131\u015ft\u0131rma \u015fart\u0131, y\u00fczde 3&#8217;e indirildi. \u00d6zel sekt\u00f6r\u00fcn \u00e7al\u0131\u015ft\u0131rmakta zorunlu oldu\u011fu y\u00fczde 3&#8217;I\u00fck \u00f6z\u00fcrl\u00fc kontenjan\u0131nda istihdam edilenlerin primleri, i\u015fveren ad\u0131na Hazine \u00f6deyecek.<\/p>\n<p><strong>\u0130\u015f yeri kurma izni kald\u0131r\u0131l\u0131yor <\/strong><\/p>\n<p>ILO s\u00f6zle\u015fmesinde belirtildi\u011fi \u015fekilde, i\u015f yerlerinde sa\u011fl\u0131\u011fa zararl\u0131 risklerin tan\u0131nnlanmas\u0131 ve de\u011ferlendirilmesi zorunlulu\u011fu getiriliyor. \u0130\u015f yerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u015fartlar\u0131n\u0131n belirlenmesi ve gerekli \u00f6nlemlerin ve \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n d\u00fczenlenmesi Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fc al\u0131narak \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca \u00e7\u0131kar\u0131lacak y\u00f6netmeliklerle belirlenecek.<\/p>\n<p>\u0130\u015f yerinin a\u00e7\u0131lmas\u0131na izin vermeye yetkili belediyeler ile di\u011fer ilgili makamlar bu izni vermeden \u00f6nce, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca verilmesi gerekli i\u015fletme belgesinin varl\u0131\u011f\u0131n\u0131 ara\u015ft\u0131racak. \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca i\u015fletme belgesi verilmemi\u015f i\u015f yerlerine belediyeler veya di\u011fer ilgili makamlarca i\u015f yeri a\u00e7\u0131lma izni verilemeyecek. B\u00f6ylece, i\u015f yerlerinin kurulmas\u0131yla ilgili prosed\u00fcrler hafifletilerek, i\u015f yerlerinin kurulmas\u0131n\u0131 \u00f6zendirmek amac\u0131yla kurma izni alma mecburiyeti kanun metninden \u00e7\u0131kar\u0131l\u0131yor.<\/p>\n<p><strong>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi&#8230;<\/strong><\/p>\n<p>\u0130\u015fverenler; devaml\u0131 olarak en az 50 i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 i\u015f yerlerinde al\u0131nmas\u0131 gereken i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerinin belirlenmesi ve uygulanmas\u0131n\u0131n izlenmesi, y\u00fcr\u00fct\u00fclmesi amac\u0131yla, i\u015f\u00e7i say\u0131s\u0131, i\u015f yerinin niteli\u011fi ve i\u015fin tehlike s\u0131n\u0131f ve derecesine g\u00f6re; bir i\u015f yeri sa\u011fl\u0131k ve g\u00fcvenlik birimi olu\u015fturmakla y\u00fck\u00fcml\u00fc olacak.<\/p>\n<p>\u0130\u015fverenler, bu y\u00fck\u00fcml\u00fcl\u00fcklerinin tamam\u0131n\u0131 veya bir k\u0131sm\u0131n\u0131, b\u00fcnyesinde \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 ve \u00e7\u0131kar\u0131lacak y\u00f6netmelikte belirtilen vas\u0131flara sahip personel ile yerine getirebilece\u011fi gibi, i\u015fletme\u00a0d\u0131\u015f\u0131nda kurulu ortak sa\u011fl\u0131k ve g\u00fcvenlik birimlerinden hizmet alarak da yerine getirebilecek. Bu \u015fekilde hizmet al\u0131nmas\u0131 i\u015fverenin sorumluklar\u0131n\u0131 ortadan kald\u0131rmayacak. Kamu kurum ve kurulu\u015flar\u0131nda \u00e7al\u0131\u015ft\u0131nlmakta olan hekimler, \u00e7al\u0131\u015fmakta olduklar\u0131 kurum ve kurulu\u015flar\u0131n \u00e7al\u0131\u015ft\u0131rd\u0131klan i\u015f\u00e7ilerin i\u015f yeri hekimli\u011fi hizmetlerini y\u00fcr\u00fctecek. Bu kurum ve kurulu\u015flar\u0131n di\u011fer personel i\u00e7in olu\u015fturulmu\u015f olan sa\u011fl\u0131k birimleri, i\u015f yeri sa\u011fl\u0131k ve g\u00fcvenlik birimi olarak da kullan\u0131labilecek.<\/p>\n<p><strong>A\u011f\u0131r ve tehlikeli i\u015flerde e\u011fitim zorunlulu\u011fu&#8230; <\/strong><\/p>\n<p>A\u011f\u0131r ve tehlikeli i\u015flerde \u00e7al\u0131\u015ft\u0131nlacaldara, mesleki e\u011fitim \u015fart\u0131 aranacak. Mesleki e\u011fitim almam\u0131\u015f i\u015f\u00e7iler; 16 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f gen\u00e7 i\u015f\u00e7iler ve \u00e7ocuklar gibi a\u011f\u0131r ve tehlikeli i\u015flerde \u00e7al\u0131\u015ft\u0131nlamayacak. Kre\u015f kurma zorunlulu\u011fu bulunan i\u015fletmeler, bu hizmeti d\u0131\u015far\u0131dan alabilecek.<\/p>\n<p><strong>Muvazaal\u0131 bildirime 10 bin YTL ceza.<\/strong><\/p>\n<p>Yapt\u0131\u011f\u0131 i\u015fle ilgili b\u00f6lge m\u00fcd\u00fcrl\u00fcklerine bildirimde bulunmayan alt i\u015fverene, \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 her i\u015f\u00e7i i\u00e7in 150 YTL, ceza verilecek. On alt\u0131 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f gen\u00e7 i\u015f\u00e7iler, \u00e7ocuklar ve mesleki e\u011fitim almam\u0131\u015f ki\u015fileri, a\u011f\u0131r ve tehlikeli i\u015flerde \u00e7al\u0131\u015ft\u0131ranlara her i\u015f\u00e7i i\u00e7in 1000 YTL, i\u015f yerini muvazaal\u0131 olarak bildiren as\u0131l i\u015fveren ile alt i\u015fveren veya vekillerine ayr\u0131 ayr\u0131 10 bin YTL idari para cezas\u0131 verilecek.<\/p>\n<p>\u0130\u015f yerinde al\u0131nmayan her i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemi i\u00e7in i\u015fverene 200 YTL ceza uygulanacak. \u00d6nlemlerin al\u0131nmamas\u0131 halinde bu ceza her ay birer defa al\u0131nmaya devam edilecek. A\u011f\u0131r ve tehlikeli i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7iler ile \u00e7al\u0131\u015ft\u0131r\u0131lan 18 ya\u015f\u0131ndan k\u00fc\u00e7\u00fckler i\u00e7in doktor raporu almayan i\u015fverene, her i\u015f\u00e7i i\u00e7in 200 YTL ceza verilecek.<\/p>\n<p>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin sa\u011flanmas\u0131 i\u00e7in gerekli her t\u00fcrl\u00fc \u00f6nlemi almayan, ara\u00e7 ve gere\u00e7ler&#8217; noksans\u0131z bulundurnnayan i\u015fverenlere, i\u015fletme belgesi almadan i\u015f yeri a\u00e7anlara, faaliyeti durdurulan i\u015fi izin almadan devam ettiren veya kapat\u0131lan i\u015f yerlerini izinsiz a\u00e7anlara, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurullannca al\u0131nan kararlar\u0131 uygulamayanlara 1000 YTL ceza uygulanacak.<\/p>\n<p>A\u011f\u0131r ve tehlikeli i\u015flerde 16 ya\u015f\u0131ndan k\u00fc\u00e7\u00fckleri \u00e7al\u0131\u015ft\u0131ran i\u015fveren veya vekili, her i\u015f\u00e7i i\u00e7in 1000 YTL, mesleki e\u011fitim almam\u0131\u015f i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren veya vekili ise her i\u015f\u00e7i i\u00e7in 500 YTL ceza \u00f6deyecek.
