Kabul edilen yasayla,\u00a0i\u015fkollar\u0131 yeniden belirleniyor. \u0130\u015fkolu\u00a0say\u0131s\u0131, 28&#8217;den 20\u2019ye d\u00fc\u015f\u00fcr\u00fcl\u00fcyor.<\/p>\n<p>TBMM Genel Kurulunda kabul edilen\u00a0yasaya g\u00f6re \u201cAvc\u0131l\u0131k, bal\u0131k\u00e7\u0131l\u0131k, tar\u0131m ve\u00a0ormanc\u0131l\u0131k\u201d, \u201cG\u0131da sanayi\u201d, \u201cMadencilik ve\u00a0ta\u015f ocaklar\u0131\u201d, \u201cPetrol, kimya, lastik, plastik\u00a0ve ila\u00e7\u201d, \u201cDokuma, haz\u0131r giyim ve deri\u201d,\u00a0\u201cA\u011fa\u00e7 ve k\u00e2\u011f\u0131t\u201d, \u201c\u0130leti\u015fim\u201d, \u201cBas\u0131n-yay\u0131n ve\u00a0gazetecilik\u201d, \u201cBanka, finans ve sigorta\u201d, \u201cTicaret,\u00a0b\u00fcro, e\u011fitim ve g\u00fczel sanatlar\u201d, \u201c\u00c7imento,\u00a0toprak ve cam\u201d, \u201cMetal\u201d, \u201c\u0130n\u015faat\u201d,\u00a0\u201cEnerji, \u201cTa\u015f\u0131mac\u0131l\u0131k\u201d, \u201cGemi yap\u0131m\u0131 ve deniz\u00a0ta\u015f\u0131mac\u0131l\u0131\u011f\u0131, ardiye ve antrepoculuk\u201d,\u00a0\u201cSa\u011fl\u0131k, sosyal hizmetler\u201d, \u201cKonaklama ve\u00a0e\u011flence i\u015fleri\u201d, \u201cSavunma ve g\u00fcvenlik\u201d ile\u00a0\u201cGenel i\u015fler\u201d olmak \u00fczere 20 i\u015fkolu olacak.<\/p>\n<p>Yeni yasan\u0131n getirdi\u011fi d\u00fczenlemeye g\u00f6re\u00a0sendika \u00fcyeli\u011fi ve \u00fcyelikten \u00e7\u0131kmak i\u00e7in\u00a0noter \u015fart\u0131 kald\u0131r\u0131l\u0131yor. Bir i\u015f yerinin girdi\u011fi\u00a0i\u015fkolunun tespiti \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik<br \/>\nBakanl\u0131\u011f\u0131nca yap\u0131lacak. Bu tespite\u00a0kar\u015f\u0131 15 g\u00fcn i\u00e7inde dava a\u00e7\u0131labilecek. Mahkeme\u00a02 ay i\u00e7inde karar verecek, karar\u0131n\u00a0temyiz edilmesi halinde Yarg\u0131tay, konuyu 2\u00a0ay i\u00e7inde kesin olarak karara ba\u011flayacak.<\/p>\n<p>\u201cZimmet, irtikap, r\u00fc\u015fvet, h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k,\u00a0sahtecilik, g\u00fcveni k\u00f6t\u00fcye kullanma,\u00a0hileli iflas, ihaleye fesat kar\u0131\u015ft\u0131rma,\u00a0edimin ifas\u0131na fesat kar\u0131\u015ft\u0131rma, su\u00e7tan kaynaklanan<br \/>\nmal varl\u0131\u011f\u0131 de\u011ferlerini aklama ve\u00a0ka\u00e7ak\u00e7\u0131l\u0131k\u201d su\u00e7lar\u0131ndan birinden mahkumiyeti\u00a0bulunanlar, sendika kurucusu olamayacak.<\/p>\n<p>Sendika kuruculu\u011funda, fiil ehliyete\u00a0sahip olman\u0131n yan\u0131 s\u0131ra fiilen \u00e7al\u0131\u015fma \u015fart\u0131\u00a0da aranacak.<\/p>\n<p>Sendika \u00dcyeli\u011fi<\/p>\n<p>\u0130\u015f\u00e7i sendikalar\u0131na \u00fcye olmak i\u00e7in 16\u00a0ya\u015f olan s\u0131n\u0131r, 15 ya\u015fa indirilecek. Sendikaya\u00a0\u00fcye olmak serbest olacak. Hi\u00e7 kimse\u00a0sendikaya \u00fcye olmaya veya olmamaya zorlanamayacak.\u00a0\u0130\u015f\u00e7i veya i\u015fverenler, ayn\u0131 i\u015fkolunda\u00a0ve ayn\u0131 zamanda birden \u00e7ok sendikaya\u00a0\u00fcye olamayacak. Ancak ayn\u0131 i\u015fkolunda\u00a0ve ayn\u0131 zamanda farkl\u0131 i\u015fverenlere ait<br \/>\ni\u015f yerlerinde \u00e7al\u0131\u015fan i\u015f\u00e7iler birden \u00e7ok sendikaya\u00a0\u00fcye olabilecek. Bir i\u015f yerinde yard\u0131mc\u0131\u00a0i\u015flerde \u00e7al\u0131\u015fan i\u015f\u00e7iler de i\u015f yerinin\u00a0girdi\u011fi i\u015fkolunda kurulu bir sendikaya \u00fcye\u00a0olabilecek.<\/p>\n<p>Sendikaya \u00fcyelik, bakanl\u0131k\u00e7a sa\u011flanacak\u00a0elektronik ba\u015fvuru sistemine, e-devlet\u00a0kap\u0131s\u0131 \u00fczerinden \u00fcyelik ba\u015fvurusunda bulunulmas\u0131\u00a0ve sendika t\u00fcz\u00fc\u011f\u00fcnde belirlenen\u00a0yetkili organ\u0131n kabul\u00fc ile e-devlet kap\u0131s\u0131\u00a0\u00fczerinden kazan\u0131lacak. \u00dcyelik ba\u015fvurusu,\u00a0sendika taraf\u0131ndan 30 g\u00fcn i\u00e7inde reddedilmedi\u011fi\u00a0takdirde, kabul edilmi\u015f say\u0131lacak.\u00a0Hakl\u0131 bir neden g\u00f6sterilmeden \u00fcyelik ba\u015fvurusu\u00a0kabul edilmeyenler, bu karar\u0131n\u00a0kendilerine tebli\u011finden itibaren 30 g\u00fcn\u00a0i\u00e7inde yetkili mahkemede dava a\u00e7abilecek.\u00a0Mahkemenin karar\u0131 kesin olacak. Mahkemenin\u00a0davac\u0131 lehine karar vermesi halinde\u00a0\u00fcyelik, ret karar\u0131n\u0131n al\u0131nd\u0131\u011f\u0131 tarihte kazan\u0131lm\u0131\u015f\u00a0say\u0131lacak.<\/p>\n<p>\u0130\u015f\u00e7iler Aras\u0131nda Ayr\u0131m Yap\u0131lamayacak<\/p>\n<p>Yasada, i\u015f\u00e7i kurulu\u015fu y\u00f6neticili\u011fi ve i\u015f\u00a0yeri sendika temsilcili\u011finin g\u00fcvenceleri de\u00a0d\u00fczenleniyor.\u00a0\u0130\u015f\u00e7ilerin i\u015fe al\u0131nmalar\u0131 belli bir sendikaya\u00a0girmeleri veya girmemeleri, belli bir\u00a0sendikadaki \u00fcyeli\u011fi s\u00fcrd\u00fcrmeleri veya \u00fcyelikten\u00a0\u00e7ekilmeleri veya herhangi bir sendikaya\u00a0\u00fcye olmalar\u0131 veya olmamalar\u0131 \u015fart\u0131na\u00a0ba\u011fl\u0131 tutulamayacak.<\/p>\n<p>\u0130\u015fveren, bir sendikaya \u00fcye olan i\u015f\u00e7ilerle\u00a0sendika \u00fcyesi olmayan i\u015f\u00e7iler veya ayr\u0131\u00a0sendikalara \u00fcye olan i\u015f\u00e7iler aras\u0131nda, \u00e7al\u0131\u015fma\u00a0\u015fartlar\u0131 veya \u00e7al\u0131\u015ft\u0131rmaya son verilmesi\u00a0bak\u0131m\u0131ndan herhangi bir ayr\u0131m yapamayacak.<\/p>\n<p>\u0130\u015f\u00e7iler, sendikaya \u00fcye olmalar\u0131 veya olmamalar\u0131,\u00a0i\u015f saatleri d\u0131\u015f\u0131nda veya i\u015fverenin\u00a0izni ile i\u015f saatleri i\u00e7inde i\u015f\u00e7i kurulu\u015flar\u0131n\u0131n\u00a0faaliyetlerine kat\u0131lmalar\u0131 veya sendikal faaliyette\u00a0bulunmalar\u0131ndan dolay\u0131 i\u015ften \u00e7\u0131kar\u0131lamayacak\u00a0veya farkl\u0131 i\u015fleme tabi tutulamayacak.<\/p>\n<p>\u0130\u015fverenin, fesih d\u0131\u015f\u0131nda ayk\u0131r\u0131 hareket\u00a0etmesi halinde i\u015f\u00e7inin bir y\u0131ll\u0131k \u00fccret tutar\u0131ndan\u00a0az olmamak \u00fczere sendikal tazminata\u00a0h\u00fckmedilecek.<\/p>\n<p>Sendikal nedenlerden dolay\u0131 i\u015f s\u00f6zle\u015fmesinin\u00a0feshi halinde i\u015f\u00e7i, dava a\u00e7ma hakk\u0131na\u00a0sahip olacak. Bu durumda i\u015f\u00e7inin 1\u00a0y\u0131ll\u0131k \u00fccret tutar\u0131ndan az olmamak \u00fczere\u00a0sendikal tazminata h\u00fckmedilecek. Sendikal\u00a0tazminat, i\u015fverenin i\u015fe ba\u015flatmas\u0131 veya\u00a0ba\u015flatmamas\u0131 \u015fart\u0131na ba\u011fl\u0131 olmayacak.<\/p>\n<p>\u0130\u015f s\u00f6zle\u015fmesinin sendikal nedenle feshedildi\u011fi\u00a0iddias\u0131yla a\u00e7\u0131lacak davada, feshin\u00a0nedenini ispat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc i\u015fverene ait\u00a0olacak.
