Sadece \u00e7al\u0131\u015fma ya\u015fam\u0131 i\u00e7in de\u011fil di\u011fer alanlarda da bir g\u00fcvenlik k\u00fclt\u00fcr\u00fc eksikli\u011finden bahsetmenin m\u00fcmk\u00fcn oldu\u011funu ve bu sorunun g\u00f6z ard\u0131 edilmemesi gerekti\u011fini vurgulad\u0131. Bu kapsamda, \u00fclke \u00e7ap\u0131nda t\u00fcm i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ko\u015fullar\u0131n\u0131n eksiksiz sa\u011flanmas\u0131n\u0131 teminat alt\u0131na almak, i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131n\u0131n \u00f6nlenmesini sa\u011flamak \u00fczere mevzuat \u00e7al\u0131\u015fmalar\u0131n\u0131n yan\u0131 s\u0131ra Bakanl\u0131\u011f\u0131m\u0131z taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan seminerler, haftalar, i\u015fbirlikleri, ulusal ve uluslararas\u0131 projeler, payda\u015flara y\u00f6nelik bilgilendirme ve e\u011fitim \u00e7al\u0131\u015fmalar\u0131, ilgili t\u00fcm sosyal taraflar ile i\u015fbirli\u011fi i\u00e7erisinde ger\u00e7ekle\u015ftirilmektedir.<\/p>\n<p style=\"text-align: justify;\">Bu \u00e7al\u0131\u015fmalar\u0131 hayata ge\u00e7irirken sa\u011fl\u0131kl\u0131 ve g\u00fcvenli \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n sa\u011flanmas\u0131, devaml\u0131l\u0131\u011f\u0131, i\u015f kalitesinin art\u0131r\u0131lmas\u0131 ve bunlara ba\u011fl\u0131 olarak i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131n\u0131n \u00f6nlenmesinin sadece yasal d\u00fczenlemelerle de\u011fil, toplumda g\u00fcvenlik k\u00fclt\u00fcr\u00fcn\u00fcn olu\u015fturulmas\u0131yla m\u00fcmk\u00fcn olaca\u011f\u0131 ger\u00e7e\u011fi temel yakla\u015f\u0131m\u0131m\u0131zd\u0131r.<\/p>\n<p style=\"text-align: justify;\">Sa\u011fl\u0131kl\u0131 ve g\u00fcvenli davran\u0131\u015f bilinci olu\u015fturmak i\u00e7in anaokulundan \u00fcniversiteye, evden okula ve i\u015fyerine kadar hayat\u0131n b\u00fct\u00fcn alanlar\u0131n\u0131 kapsayacak \u015fekilde vatanda\u015flar\u0131n g\u00fcvenlik bilinci d\u00fczeylerinin art\u0131r\u0131lmas\u0131 gerekmektedir. Bu nedenle 2000\u2019li y\u0131llardan bu yana Bakanl\u0131k olarak bu alanda pek \u00e7ok ulusal ve uluslararas\u0131 proje ger\u00e7ekle\u015ftirilmi\u015f ve t\u00fcm ilgili taraflar\u0131 kapsayan bir\u00e7ok seminer, toplant\u0131 ve e\u011fitim d\u00fczenlenerek farkl\u0131 platformlarda konu detayl\u0131 \u015fekilde ele al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Di\u011fer yandan i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finin tarihsel geli\u015fimi incelendi\u011finde, sanayi devrimi ile birlikte ba\u015flayan \u00fcretim odakl\u0131 anlay\u0131\u015f bir yandan \u00e7al\u0131\u015fma hayat\u0131n\u0131 yak\u0131ndan etkileyen ekonomik, sosyal ve siyasal ko\u015fullar\u0131n de\u011fi\u015fime u\u011framas\u0131, di\u011fer yandan artan i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131 ile birlikte yerini insan odakl\u0131 anlay\u0131\u015fa b\u0131rakm\u0131\u015f ve \u00fclkeler bu de\u011fi\u015fime paralel olarak mevzuat alt yap\u0131lar\u0131n\u0131 yeniden g\u00f6zden ge\u00e7irmek zorunda kalm\u0131\u015flard\u0131r. \u00c7al\u0131\u015fma hayat\u0131ndan sorumlu olan Bakanl\u0131\u011f\u0131m\u0131z bu geli\u015fmelerin d\u0131\u015f\u0131nda kalmam\u0131\u015f, imzalad\u0131\u011f\u0131m\u0131z uluslararas\u0131 s\u00f6zle\u015fmeler ve AB uyum s\u00fcreci taahh\u00fctlerini de esas alarak \u00e7al\u0131\u015fma hayat\u0131n\u0131n gereklilikleri do\u011frultusunda haz\u0131rlanm\u0131\u015f olan ve kamu veya \u00f6zel sekt\u00f6r \u00e7al\u0131\u015fanlar\u0131 gibi ayr\u0131mlar\u0131 ve say\u0131 s\u0131n\u0131rland\u0131rmalar\u0131n\u0131 i\u00e7ermeyen ve b\u00fct\u00fcnsel anlamda t\u00fcm \u00e7al\u0131\u015fanlar\u0131 kapsayan \u201c\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u201dnu t\u00fcm taraflar\u0131n da destek ve \u00e7abalar\u0131yla yay\u0131mlanmas\u0131n\u0131 sa\u011flam\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bakanl\u0131\u011f\u0131m\u0131z\u0131n Kanun yay\u0131mland\u0131ktan sonraki en \u00f6nemli \u00e7al\u0131\u015fmas\u0131 mevzuat haz\u0131rl\u0131\u011f\u0131 olmu\u015ftur. Gerek ilgili AB mevzuat\u0131n\u0131n yeniden g\u00f6zden ge\u00e7irilerek de\u011fi\u015fikliklerin ilgili d\u00fczenlemelere yans\u0131t\u0131lmas\u0131n\u0131n yan\u0131 s\u0131ra al\u0131nan geri bildirimler ve ihtiya\u00e7lar do\u011frultusunda yap\u0131lan de\u011fi\u015fiklikler gerekse Kanunun s\u0131n\u0131rl\u0131 istisnas\u0131 d\u0131\u015f\u0131nda hemen hemen t\u00fcm \u00e7al\u0131\u015fanlar\u0131 kapsamas\u0131 nedeni ile ortaya \u00e7\u0131kan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcne y\u00f6nelik ilgili taraflarla m\u00fczakere s\u00fcreci nedeni ile bu \u00e7al\u0131\u015fmalar olduk\u00e7a zaman alm\u0131\u015ft\u0131r. H\u00e2lihaz\u0131rda planlad\u0131\u011f\u0131m\u0131z 37 y\u00f6netmelikten 34\u2019\u00fc yay\u0131mlanm\u0131\u015f, 2 tanesi ise yay\u0131ma haz\u0131r haldedir. \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Hizmetlerinin Desteklenmesi Hakk\u0131nda Y\u00f6netmelik Tasla\u011f\u0131 ise ilgili taraflara g\u00f6r\u00fc\u015fe g\u00f6nderilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Mevzuat \u00e7al\u0131\u015fmalar\u0131na paralel olarak, Kanunun getirdi\u011fi y\u00fck\u00fcml\u00fcl\u00fckler konusunda t\u00fcm ilgili taraflar\u0131n bilgilendirilmesi amac\u0131 ile 81 ilimizi kapsayan \u0130SG Kanunu Tan\u0131t\u0131m Kampanyas\u0131 d\u00fczenlenmi\u015ftir. Bu kapsamda d\u00fczenlenen toplant\u0131lara 30000\u2019in \u00fczerinde ki\u015fi kat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Ayr\u0131ca t\u00fcm kamu kurumlar\u0131 temsilcileri Bakanl\u0131\u011f\u0131m\u0131za davet edilerek bilgilendirme toplant\u0131lar\u0131 yap\u0131lm\u0131\u015f ve bu konuda ilgili kurum ve kurulu\u015flarca yap\u0131lan davetlere azami \u00f6l\u00e7\u00fcde kat\u0131l\u0131m sa\u011flayarak \u00e7ok \u00e7e\u015fitli platformlarda Kanun anlat\u0131lm\u0131\u015f, tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Bunlar\u0131n yan\u0131 s\u0131ra \u00f6zellikle KOB\u0130 niteli\u011findeki mikro i\u015fletmelere ve esnaflara yard\u0131mc\u0131 olmak ve bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn getirece\u011fi mali y\u00fck\u00fc hafifletmek amac\u0131yla \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcm\u00fcz web sayfas\u0131nda \u201cRisk De\u011ferlendirmesi Rehberleri\u201d yay\u0131nlanmaktad\u0131r. Di\u011fer yandan daha \u00f6nce bir AB projesi kapsam\u0131nda maden, metal ve in\u015faat sekt\u00f6rlerinde uygulamaya konan sekt\u00f6rel \u0130SG y\u00f6netim sistemi modellerinin yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131 ve kimya, deri, mobilya, g\u0131da, tekstil sekt\u00f6rlerine y\u00f6nelik yeni modellerin olu\u015fturulmas\u0131 amac\u0131yla ulusal kaynaklar\u0131m\u0131zla 2013-2015 y\u0131llar\u0131 aras\u0131nda uygulanacak \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011finin Geli\u015ftirilmesi Projesinin \u00f6n haz\u0131rl\u0131klar\u0131 tamamlanm\u0131\u015ft\u0131r. Bu proje ile KOB\u0130 niteli\u011findeki i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunun bir sistem anlay\u0131\u015f\u0131 ile ele al\u0131nmas\u0131 ve risk de\u011ferlendirmesine dayal\u0131 \u00f6nleyici yakla\u015f\u0131m\u0131n hayata ge\u00e7irilmesi sa\u011flanacakt\u0131r.<\/p>\n<p>\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Yasas\u0131 hen\u00fcz \u00e7ok yeni bir yasa ama y\u00fcr\u00fcrl\u00fc\u011fe girmesinden sonra ge\u00e7en s\u00fcrede genel olarak yans\u0131mas\u0131 nas\u0131l oldu? \u0130\u015f kazalar\u0131, meslek hastal\u0131klar\u0131ndaki genel durum nedir?<\/p>\n<p>6331 say\u0131l\u0131 Kanun, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011finde en iyi ko\u015fullar\u0131 hedefleyerek, \u00e7al\u0131\u015fma ortamlar\u0131n\u0131n s\u00fcrekli iyile\u015ftirilmesi, gerekli tedbirlerin zaman\u0131nda al\u0131nmas\u0131 yoluyla \u00fclkemiz i\u015fyerlerinde daha sa\u011fl\u0131kl\u0131 ve g\u00fcvenli \u00e7al\u0131\u015fma alanlar\u0131n\u0131n olu\u015fturulmas\u0131n\u0131 hedeflemektedir.<\/p>\n<p>Sizin de belirtti\u011finiz gibi yasa \u00e7ok yeni fakat i\u015f hayat\u0131 y\u00f6n\u00fcyle incelendi\u011finde 6331 say\u0131l\u0131 Kanunun yay\u0131m\u0131 ile birlikte hem i\u015fyerlerindeki \u00e7al\u0131\u015fma ortamlar\u0131 i\u00e7erisinde geli\u015fmeler ya\u015fand\u0131\u011f\u0131 hem de \u00fclkemizdeki i\u015f kapasitesi ile istihdam\u0131n art\u0131r\u0131lmas\u0131 hususunda olumlu y\u00f6nde de\u011fi\u015fimler oldu\u011fu g\u00f6zlenmektedir.<\/p>\n<p>Kanunun i\u015f hayat\u0131na getirdi\u011fi en \u00f6nemli yenilik i\u015f\u00e7i, memur ayr\u0131m\u0131 olmaks\u0131z\u0131n t\u00fcm \u00e7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi h\u00fck\u00fcmleri kapsam\u0131na al\u0131nm\u0131\u015f olmas\u0131d\u0131r. Bunun d\u0131\u015f\u0131nda Kanunun, \u00e7al\u0131\u015fma ortamlar\u0131n\u0131n iyile\u015ftirilmesinde de \u00f6nemli katk\u0131lar\u0131 oldu\u011fu a\u015fikard\u0131r. Bunlardan ba\u015fl\u0131calar\u0131,<\/p>\n<p>\u2022 \u00d6nleyici bir yakla\u015f\u0131m benimsenerek i\u015fyerlerinde risk de\u011ferlendirmesi yap\u0131lmas\u0131 zorunlu hale getirilmektedir. Risk de\u011ferlendirmesi ile birlikte i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131 ortaya \u00e7\u0131kt\u0131ktan sonra neler yap\u0131labilece\u011fi de\u011fil, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131n\u0131n \u00f6nlenmesi i\u00e7in at\u0131lacak ad\u0131mlar esas olacakt\u0131r. Ayn\u0131 zamanda risk de\u011ferlendirmesi ger\u00e7ekle\u015ftirilirken gen\u00e7, ya\u015fl\u0131, engelli, gebe veya emziren \u00e7al\u0131\u015fanlar gibi \u00f6zel politika gerektiren gruplar ile kad\u0131n \u00e7al\u0131\u015fanlar\u0131n durumu da \u00f6zel olarak de\u011ferlendirilecektir.<\/p>\n<p>\u2022 \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili konularda \u00e7al\u0131\u015fanlar\u0131 temsil etmeye yetkili \u00e7al\u0131\u015fan temsilcisi kavram\u0131 getirilmi\u015ftir.<\/p>\n<p>\u2022 \u00c7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusundaki karar alma faaliyetlerine kat\u0131lmalar\u0131 sa\u011flanmaktad\u0131r.<\/p>\n<p>\u2022 Bakanl\u0131k, mikro i\u015fletmelere i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi hizmetleri konusunda destek sa\u011flayacakt\u0131r.<\/p>\n<p>\u2022 \u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi profesyonellerinin, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili hususlar\u0131 i\u015fverene iletme ve i\u015fverence uyulmayan hayati tehlike arz edenleri Bakanl\u0131\u011fa bildirme hakk\u0131 getirilmi\u015ftir.<\/p>\n<p>\u2022 \u0130\u015fyerlerinin toplu halde bulundu\u011fu yerlerde, ayn\u0131 i\u015fyerini birden fazla i\u015fverenin payla\u015fmas\u0131 durumunda veya birden fazla i\u015fyerinin bulundu\u011fu yerlerde her bir i\u015fyerinin kendi sa\u011fl\u0131k ve g\u00fcvenlik ko\u015fullar\u0131n\u0131 sa\u011flamas\u0131n\u0131n yan\u0131nda bu i\u015fyerlerinin birbirlerini etkilemesi muhtemel unsurlara sahip olmalar\u0131 ve bu konularda ortakla\u015fa hareket etmelerine olanak tan\u0131mak \u00fczere i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi koordinasyonunun sa\u011flanmas\u0131 temin edilmi\u015ftir.<\/p>\n<p>\u2022 T\u00fcm i\u015fyerlerinin acil durumlara kar\u015f\u0131 haz\u0131r olmas\u0131 i\u00e7in ilkyard\u0131m, yang\u0131nla m\u00fccadele, afet, tahliye gibi durumlar i\u00e7in \u00f6nceden acil durum planlar\u0131 haz\u0131rlanacakt\u0131r. Bu planlarla ilgili t\u00fcm \u00e7al\u0131\u015fanlar\u0131n kat\u0131laca\u011f\u0131 e\u011fitimler ve tatbikatlar yap\u0131lacakt\u0131r.<\/p>\n<p>\u2022 Elli ve daha fazla \u00e7al\u0131\u015fan\u0131n bulundu\u011fu ve alt\u0131 aydan fazla s\u00fcren i\u015flerin yap\u0131ld\u0131\u011f\u0131 t\u00fcm i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurulu olu\u015fturulacakt\u0131r.<\/p>\n<p>\u2022 \u00c7al\u0131\u015fan ciddi ve yak\u0131n tehlike ile kar\u015f\u0131 kar\u015f\u0131ya kald\u0131\u011f\u0131nda, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kuruluna, kurulun bulunmad\u0131\u011f\u0131 yerlerde ise i\u015fverene bu durumun giderilmesi i\u00e7in ba\u015fvurarak gerekli tedbirler al\u0131n\u0131ncaya kadar \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131na sahip olacakt\u0131r. Tedbir al\u0131nmad\u0131\u011f\u0131 durumda ise \u00e7al\u0131\u015fanlar i\u015f s\u00f6zle\u015fmelerini feshedebileceklerdir.<\/p>\n<p>\u015feklinde s\u0131ralanabilir. Bunlar\u0131n yan\u0131 s\u0131ra, Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f olmas\u0131 \u00fclkemizdeki i\u015f kapasitesi ve nitelikli \u00e7al\u0131\u015fan istihdam\u0131 \u00fczerinde de etkili olmu\u015ftur. Kanunun 6\u2019nc\u0131 maddesi uyar\u0131nca i\u015fverenler i\u015fyerlerinde, \u00e7al\u0131\u015fanlar\u0131 aras\u0131ndan uygun niteliklere haiz ki\u015fileri i\u015f g\u00fcvenli\u011fi uzman\u0131, i\u015fyeri hekimi veya di\u011fer sa\u011fl\u0131k personeli olarak g\u00f6revlendirebilecekleri gibi bu hizmetin t\u00fcm\u00fcn\u00fc veya bir k\u0131sm\u0131n\u0131 i\u015fyeri d\u0131\u015f\u0131ndaki kurulu\u015flardan hizmet alarak da yerine getirebileceklerdir. D\u0131\u015far\u0131dan hizmet al\u0131nmas\u0131 noktas\u0131nda Ortak Sa\u011fl\u0131k ve G\u00fcvenlik Birimleri (OSGB) devreye girmektedir. OSGB\u2019ler her ne kadar 4857 say\u0131l\u0131 Kanun \u00e7er\u00e7evesinde temelleri at\u0131lm\u0131\u015f bir yap\u0131lanma olsa da 6331 say\u0131l\u0131 Kanun uyar\u0131nca i\u00e7eri\u011fi, olu\u015fumu ve niteli\u011fi g\u00fc\u00e7lenmi\u015f ve hizmet alan\u0131 geni\u015flemi\u015ftir.<\/p>\n<p>2000\u2019li y\u0131llar\u0131n ba\u015f\u0131nda ba\u015flayan ve 2012 y\u0131l\u0131nda \u00fclkemize kazand\u0131r\u0131lan m\u00fcstakil \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu ile getirilen de\u011fi\u015fim ve geli\u015fmelere paralel olarak i\u015f kazalar\u0131 a\u00e7\u0131s\u0131ndan ne durumday\u0131z diye bir de\u011ferlendirme yapacak olursak uzun vadede yap\u0131lan \u00e7al\u0131\u015fmalar\u0131n istatistiklere istedi\u011fimiz y\u00f6nde fakat yine de yetersiz d\u00fczeyde yans\u0131d\u0131\u011f\u0131n\u0131 g\u00f6rebiliriz. Bu yans\u0131may\u0131 rakamlarla da vermek isterim.<\/p>\n<p>Sosyal G\u00fcvenlik Kurumu istatistiklerine g\u00f6re 2002 y\u0131l\u0131nda \u00fclkemizde 727.409 i\u015fyeri faaliyet g\u00f6stermi\u015f ve bu i\u015fyerlerinde 5.223.283 \u00e7al\u0131\u015fan istihdam edilmi\u015ftir. Bu i\u015fyerlerinde 72.344 i\u015f kazas\u0131 ve 601 meslek hastal\u0131\u011f\u0131 meydana gelmi\u015f, bu vakalar\u0131n 878\u2019i \u00f6l\u00fcmle sonu\u00e7lanm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla y\u00fcz bin i\u015f\u00e7ide i\u015f kazas\u0131 oran\u0131 1385, \u00f6l\u00fcm oran\u0131 ise 16.8 olarak tespit edilmi\u015ftir. SGK\u2019n\u0131n konu ile ilgili en g\u00fcncel verileri olan 2012 y\u0131l\u0131 verileri incelendi\u011finde ise \u00fclkemizde 1.538.006 i\u015fyerinde 11.939.620 \u00e7al\u0131\u015fan istihdam edilmi\u015f olup bu i\u015fyerlerinde 74.871 i\u015f kazas\u0131 ile 395 meslek hastal\u0131\u011f\u0131 meydana gelmi\u015ftir. \u00d6l\u00fcm say\u0131s\u0131 ise 745\u2019tir. Buna g\u00f6re, y\u00fcz bin i\u015f\u00e7ide i\u015f kazas\u0131 oran\u0131 627 \u00f6l\u00fcm oran\u0131 ise 6.2 olarak hesaplanm\u0131\u015ft\u0131r.
