{"id":82,"date":"2012-12-28T08:26:44","date_gmt":"2012-12-28T06:26:44","guid":{"rendered":"http:\/\/www.istesaglikdergisi.com.tr\/index.php\/2012\/12\/28\/iscilerin-yazili-onayini-gerektiren-durumlar\/"},"modified":"2020-10-09T21:49:32","modified_gmt":"2020-10-09T18:49:32","slug":"iscilerin-yazili-onayini-gerektiren-durumlar","status":"publish","type":"post","link":"http:\/\/www.istesaglikdergisi.com.tr\/index.php\/2012\/12\/28\/iscilerin-yazili-onayini-gerektiren-durumlar\/","title":{"rendered":"\u0130\u015f\u00e7ilerin Yaz\u0131l\u0131 Onay\u0131n\u0131 Gerektiren Durumlar"},"content":{"rendered":"<p>Bir i\u015f s\u00f6zle\u015fmesine dayanarak \u00e7al\u0131\u015fan ger\u00e7ek ki\u015fiye i\u015f\u00e7i, i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran ger\u00e7ek veya t\u00fczel ki\u015fiye yahut t\u00fczel ki\u015fili\u011fi olmayan kurum ve kurulu\u015flara i\u015fveren, i\u015f\u00e7i ile i\u015fveren aras\u0131nda kurulan ili\u015fkiye i\u015f ili\u015fkisi denir. \u0130\u015fveren taraf\u0131ndan mal veya hizmet \u00fcretmek amac\u0131yla madd\u00ee olan ve olmayan unsurlar ile i\u015f\u00e7inin birlikte \u00f6rg\u00fctlendi\u011fi birime i\u015fyeri denir.<\/p>\n<p>\u0130\u015fveren a\u015fa\u011f\u0131da a\u00e7\u0131klanan durumlarda i\u015f\u00e7inin yaz\u0131l\u0131 onay\u0131n\u0131 almadan, di\u011fer bir ifadeyle i\u015f\u00e7iyle anla\u015fmadan i\u015flem yapamaz. Onay al\u0131nmadan yap\u0131lan i\u015flem Kanuna ayk\u0131r\u0131l\u0131k te\u015fkil eder.<\/p>\n<p><strong>1. Ge\u00e7ici \u0130\u015f \u0130li\u015fkisi<\/strong><\/p>\n<p>\u0130\u015fveren, devir s\u0131ras\u0131nda yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 almak suretiyle bir i\u015f\u00e7iyi; holding b\u00fcnyesi i\u00e7inde veya ayn\u0131 \u015firketler toplulu\u011funa ba\u011fl\u0131 ba\u015fka bir i\u015fyerinde veya yapmakta oldu\u011fu i\u015fe benzer i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 ko\u015fuluyla ba\u015fka bir i\u015fverene i\u015f g\u00f6rme edimini yerine getirmek \u00fczere ge\u00e7ici olarak devretti\u011finde ge\u00e7ici i\u015f ili\u015fkisi ger\u00e7ekle\u015fmi\u015f olur.<\/p>\n<p>Bu halde i\u015f s\u00f6zle\u015fmesi devam etmekle beraber, i\u015f\u00e7i bu s\u00f6zle\u015fmeye g\u00f6re \u00fcstlendi\u011fi i\u015fin g\u00f6r\u00fclmesini, i\u015f s\u00f6zle\u015fmesine ge\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fverene kar\u015f\u0131 yerine getirmekle y\u00fck\u00fcml\u00fc olur. Ge\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fveren i\u015f\u00e7iye talimat verme hakk\u0131na sahip olup, i\u015f\u00e7iye sa\u011fl\u0131k ve g\u00fcvenlik risklerine kar\u015f\u0131 gerekli e\u011fitimi vermekle y\u00fck\u00fcml\u00fcd\u00fcr. Ge\u00e7ici i\u015f ili\u015fkisi alt\u0131 ay\u0131 ge\u00e7memek \u00fczere yaz\u0131l\u0131 olarak yap\u0131l\u0131r, gerekti\u011finde en fazla iki defa yenilenebilir.<\/p>\n<p><strong>2. \u00c7al\u0131\u015fma Ko\u015fullar\u0131nda De\u011fi\u015fiklik<\/strong><\/p>\n<p>\u0130\u015fveren, i\u015f s\u00f6zle\u015fmesiyle veya i\u015f s\u00f6zle\u015fmesinin eki niteli\u011findeki personel y\u00f6netmeli\u011fi ve benzeri kaynaklar ya da i\u015fyeri uygulamas\u0131yla olu\u015fan \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 bir de\u011fi\u015fikli\u011fi ancak durumu i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirmek suretiyle yapabilir. Bu \u015fekle uygun olarak yap\u0131lmayan ve i\u015f\u00e7i taraf\u0131ndan alt\u0131 i\u015fg\u00fcn\u00fc i\u00e7inde yaz\u0131l\u0131 olarak kabul edilmeyen de\u011fi\u015fiklikler i\u015f\u00e7iyi ba\u011flamaz. \u0130\u015f\u00e7i de\u011fi\u015fiklik \u00f6nerisini bu s\u00fcre i\u00e7inde kabul etmezse, i\u015fveren de\u011fi\u015fikli\u011fin ge\u00e7erli bir nedene dayand\u0131\u011f\u0131n\u0131 veya fesih i\u00e7in ba\u015fka bir ge\u00e7erli nedenin bulundu\u011funu yaz\u0131l\u0131 olarak a\u00e7\u0131klamak ve bildirim s\u00fcresine uymak suretiyle i\u015f s\u00f6zle\u015fmesini feshedebilir.<\/p>\n<p><strong>3. Fazla \u00c7al\u0131\u015fma<\/strong><\/p>\n<p>Fazla \u00e7al\u0131\u015fma; \u0130\u015f Kanununda yaz\u0131l\u0131 ko\u015fullar \u00e7er\u00e7evesinde haftal\u0131k 45 saati a\u015fan \u00e7al\u0131\u015fmalard\u0131r. Fazla \u00e7al\u0131\u015fma yapt\u0131rmak i\u00e7in i\u015f\u00e7inin yaz\u0131l\u0131 onay\u0131n\u0131n al\u0131nmas\u0131 gerekir. Fazla \u00e7al\u0131\u015fma ihtiyac\u0131 olan i\u015fverence bu onay her y\u0131lba\u015f\u0131nda i\u015f\u00e7ilerden yaz\u0131l\u0131 olarak al\u0131n\u0131r ve i\u015f\u00e7i \u00f6zl\u00fck dosyas\u0131nda saklan\u0131r.<\/p>\n<p><strong>4. Serbest Zaman<\/strong><\/p>\n<p>Fazla \u00e7al\u0131\u015fma yapan i\u015f\u00e7i, isterse i\u015fverene yaz\u0131l\u0131 olarak ba\u015fvurmak ko\u015fuluyla, bu \u00e7al\u0131\u015fmalar kar\u015f\u0131l\u0131\u011f\u0131 zaml\u0131 \u00fccret yerine, fazla \u00e7al\u0131\u015ft\u0131\u011f\u0131 her saat kar\u015f\u0131l\u0131\u011f\u0131nda bir saat otuz dakikay\u0131, fazla s\u00fcrelerle \u00e7al\u0131\u015ft\u0131\u011f\u0131 her saat kar\u015f\u0131l\u0131\u011f\u0131nda bir saat onbe\u015f dakikay\u0131 serbest zaman olarak kullanabilir. \u0130\u015f\u00e7i hak etti\u011fi serbest zaman\u0131, 6 ay zarf\u0131nda i\u015fverene \u00f6nceden yaz\u0131l\u0131 olarak bildirmesi ko\u015fuluyla ve i\u015fverenin, i\u015fin veya i\u015fyerinin gereklerine uygun olarak belirledi\u011fi tarihten itibaren i\u015f g\u00fcnleri i\u00e7erisinde aral\u0131ks\u0131z ve \u00fccretinde bir kesinti olmadan kullan\u0131r. \u0130\u015f\u00e7inin bu kanundan ve s\u00f6zle\u015fmelerden kaynaklanan tatil ve izin g\u00fcnlerinde serbest zaman kulland\u0131r\u0131lamaz.<\/p>\n<p><strong>5. Denkle\u015ftirme<\/strong><\/p>\n<p>Genel bak\u0131mdan \u00e7al\u0131\u015fma s\u00fcresi haftada en \u00e7ok k\u0131rkbe\u015f saattir. Aksi kararla\u015ft\u0131r\u0131lmam\u0131\u015fsa bu s\u00fcre, i\u015fyerlerinde haftan\u0131n \u00e7al\u0131\u015f\u0131lan g\u00fcnlerine e\u015fit \u00f6l\u00e7\u00fcde b\u00f6l\u00fcnerek uygulan\u0131r. Haftan\u0131n i\u015f g\u00fcnlerinden birinde k\u0131smen \u00e7al\u0131\u015f\u0131lan i\u015fyerlerinde, bu s\u00fcre haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinden d\u00fc\u015f\u00fcld\u00fckten sonra, \u00e7al\u0131\u015f\u0131lan s\u00fcrenin \u00e7al\u0131\u015f\u0131lan g\u00fcn say\u0131s\u0131na b\u00f6l\u00fcnmesi suretiyle g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcreleri belirlenir. G\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi her ne \u015fekilde olursa olsun 11 saati a\u015famaz.<\/p>\n<p>Taraflar\u0131n yaz\u0131l\u0131 anla\u015fmas\u0131 ile haftal\u0131k normal \u00e7al\u0131\u015fma s\u00fcresi, i\u015fyerinde haftan\u0131n \u00e7al\u0131\u015f\u0131lan g\u00fcnlerine g\u00fcnde onbir saati a\u015fmamak ko\u015fuluyla farkl\u0131 \u015fekilde da\u011f\u0131t\u0131labilir. Bu halde, yo\u011funla\u015ft\u0131r\u0131lm\u0131\u015f i\u015f haftas\u0131 veya haftalar\u0131ndan sonraki d\u00f6nemde i\u015f\u00e7inin daha az s\u00fcrelerle \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 suretiyle, toplam \u00e7al\u0131\u015fma s\u00fcresi, \u00e7al\u0131\u015fmas\u0131 gereken toplam normal s\u00fcreyi ge\u00e7meyecek \u015fekilde denkle\u015ftirilir. Denkle\u015ftirme iki ayl\u0131k s\u00fcre i\u00e7inde tamamlanacak, bu s\u00fcre toplu i\u015f s\u00f6zle\u015fmeleri ile d\u00f6rt aya kadar art\u0131r\u0131labilecektir. Denkle\u015ftirme d\u00f6nemi i\u00e7inde g\u00fcnl\u00fck ve haftal\u0131k \u00e7al\u0131\u015fma s\u00fcreleri ile denkle\u015ftirme s\u00fcresi uygulamas\u0131n\u0131n ba\u015flang\u0131\u00e7 ve biti\u015f tarihleri i\u015fverence belirlenir.<\/p>\n<p><strong>6. Ulusal Bayram ve Genel Tatil<\/strong><\/p>\n<p>G\u00fcnlerinde \u00c7al\u0131\u015fma Ulusal bayram ve genel tatil g\u00fcnlerinde i\u015fyerlerinde \u00e7al\u0131\u015f\u0131l\u0131p \u00e7al\u0131\u015f\u0131lmayaca\u011f\u0131 toplu i\u015f s\u00f6zle\u015fmesi veya i\u015f s\u00f6zle\u015fmeleri ile kararla\u015ft\u0131r\u0131l\u0131r. S\u00f6zle\u015fmelerde h\u00fck\u00fcm bulunmamas\u0131 halinde s\u00f6z konusu g\u00fcnlerde \u00e7al\u0131\u015f\u0131lmas\u0131 i\u00e7in i\u015f\u00e7inin onay\u0131 gereklidir. \u0130spat \u015fart\u0131 bak\u0131m\u0131ndan bu onay\u0131n yaz\u0131l\u0131 olmas\u0131 gerekir.<\/p>\n<p><strong>Sonu\u00e7<\/strong><\/p>\n<p>\u0130\u015f Kanunu\u2019nun amac\u0131 i\u015fverenler ile bir i\u015f s\u00f6zle\u015fmesine dayanarak \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7ilerin \u00e7al\u0131\u015fma \u015fartlar\u0131 ve \u00e7al\u0131\u015fma ortam\u0131na ili\u015fkin hak ve sorumluluklar\u0131n\u0131 d\u00fczenlemektir.<\/p>\n<p>\u0130\u015f Kanunu yukar\u0131da a\u00e7\u0131klanan i\u015flemlerin yap\u0131labilmesi i\u00e7in taraflar\u0131n yani i\u015f\u00e7i ve i\u015fverenin anla\u015fmalar\u0131n\u0131 zorunlu k\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Ge\u00e7ici i\u015f ili\u015fkisinde i\u015f\u00e7inin yaz\u0131l\u0131 onay\u0131n\u0131 almayan i\u015fverene, bu durumdaki her i\u015f\u00e7i i\u00e7in 100 TL, fazla \u00e7al\u0131\u015fmada onay\u0131 al\u0131nmadan fazla \u00e7al\u0131\u015ft\u0131r\u0131lan her bir i\u015f\u00e7i i\u00e7in 204 TL, serbest zaman ve denkle\u015ftirme uygulamas\u0131nda yaz\u0131l\u0131 olma \u015fart\u0131n\u0131 yerine getirmeyen i\u015fverene 1.034 TL idari para cezas\u0131 uygulanacakt\u0131r.<\/p>\n<p>\u00c7al\u0131\u015fma ko\u015fullar\u0131nda de\u011fi\u015fikli\u011fi i\u015fveren yaz\u0131l\u0131 olarak yapmak zorundad\u0131r.
