Risk alt\u0131nda \u00e7al\u0131\u015fan personel s\u0131n\u0131rlamas\u0131na hangi gruplar giriyor?<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimi 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 77\u2019inci maddesinde d\u00fczenlenmi\u015f, \u00e7al\u0131\u015fanlara verilecek e\u011fitimin usul ve esaslar\u0131 ise yine \u0130\u015f Kanunu\u2019nun ayn\u0131 maddesi gere\u011fince yay\u0131nlanm\u0131\u015f olan \u00c7al\u0131\u015fanlar\u0131n \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi E\u011fitimlerinin Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik ile d\u00fczenlenmi\u015ftir. \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi E\u011fitimi ile ilgili mevzuat\u0131m\u0131za bakt\u0131\u011f\u0131m\u0131zda asl\u0131nda bu e\u011fitimi sadece risk alt\u0131ndaki \u00e7al\u0131\u015fanlar\u0131n de\u011fil t\u00fcm \u00e7al\u0131\u015fanlar\u0131n almas\u0131 gerekti\u011fini g\u00f6r\u00fcyoruz.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fverenler, i\u015fyerlerinde sa\u011fl\u0131kl\u0131 ve g\u00fcvenli bir ortam\u0131 temin etmek, i\u015f kazalar\u0131n\u0131 ve meslek hastal\u0131klar\u0131n\u0131 azaltmak, \u00e7al\u0131\u015fanlar\u0131 yasal hak ve sorumluluklar\u0131 konusunda bilgilendirmek, onlara kar\u015f\u0131 kar\u015f\u0131ya bulunduklar\u0131 mesleki riskler ile bu risklere kar\u015f\u0131 al\u0131nmas\u0131 gerekli tedbirleri \u00f6\u011fretmek ayr\u0131ca i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi bilinci olu\u015fturarak uygun davran\u0131\u015f kazand\u0131rmak i\u00e7in \u00e7al\u0131\u015fanlara \u00f6zellikle belirtmek istiyorum ki i\u015f s\u00f6zle\u015fmesinin t\u00fcr\u00fcne bakmaks\u0131z\u0131n gerekli e\u011fitimi vermek zorundad\u0131rlar.<\/p>\n<p style=\"text-align: justify;\">Buna g\u00f6re i\u015fverenler\u00a0 i\u015f yerlerinde sa\u011fl\u0131kl\u0131 ve g\u00fcvenli \u00e7al\u0131\u015fma ortam\u0131n\u0131n tesis edilmesi i\u00e7in gerekli \u00f6nlemleri almakla y\u00fck\u00fcml\u00fcd\u00fcrler. Bu ama\u00e7la i\u015fverenler, \u00e7al\u0131\u015fanlar\u0131 yasal hak ve\u00a0 sorumluluklar\u0131 konusunda onlar\u0131n\u00a0 kar\u015f\u0131 kar\u015f\u0131ya\u00a0 bulunduklar\u0131 mesleki riskler ve bunlarla ilgili al\u0131nmas\u0131 gerekli tedbirler konusunda\u00a0 i\u015fyerlerinde\u00a0 i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitim programlar\u0131n\u0131 haz\u0131rlamak, e\u011fitimlerin\u00a0 d\u00fczenlenmesini, \u00e7al\u0131\u015fanlar\u0131n bu programlara kat\u0131lmas\u0131n\u0131 sa\u011flamak ve verilecek e\u011fitim i\u00e7in\u00a0 uygun ara\u00e7\u00a0 gere\u00e7 ve yer temin etmekle y\u00fck\u00fcml\u00fcd\u00fcrler.<\/p>\n<p style=\"text-align: justify;\">As\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisi kurulan i\u015fyerlerinde ise, alt i\u015fverene ait \u00e7al\u0131\u015fanlar\u0131n e\u011fitimlerinden, as\u0131l i\u015fveren alt i\u015fverenle birlikte sorumludur. Ge\u00e7ici i\u015f ili\u015fkisi kurulan i\u015fveren, ge\u00e7ici i\u015f ili\u015fkisi ile \u00e7al\u0131\u015fanlara gerekli e\u011fitimi vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kurullar\u0131 Hakk\u0131nda Y\u00f6netmelik gere\u011fince, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurulu \u00fcyelerine ve yedeklerine i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konular\u0131nda e\u011fitim verilmesi gerekmektedir.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimlerini kimler veriyor? Bu e\u011fitimin ama\u00e7lar\u0131 nelerdir?<\/strong><\/p>\n<p style=\"text-align: justify;\">E\u011fitimi verebilecek ki\u015fi ve kurulu\u015flar; \u00c7al\u0131\u015fanlar\u0131n \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi E\u011fitim lerinin Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fin 15\u2019inci maddesinde d\u00fczenlenmi\u015ftir. Buna g\u00f6re i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimlerini uzmanl\u0131k konular\u0131na g\u00f6re; i\u015f g\u00fcvenli\u011fi uzmanlar\u0131, i\u015fyeri hekimleri, verilecek e\u011fitimin \u00e7e\u015fidine g\u00f6re, bu hizmeti veren veya vermeye yetkili kurum, kurulu\u015f ya da firmalardan e\u011fitim ama\u00e7l\u0131 merkezler, i\u015f\u00e7i veya i\u015fveren kurulu\u015flar\u0131nca kurulan e\u011fitim vak\u0131f- lar\u0131, i\u015fveren ve i\u015f\u00e7i kurulu\u015flar\u0131 veya bunlar taraf\u0131ndan birlikte olu\u015fturulan ortak e\u011fitim merkez ve birimleri, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konular\u0131nda \u0130\u015f M\u00fcfetti\u015fi olarak g\u00f6rev yapm\u0131\u015f olanlar verebilmektedir. Uzman ki\u015fi veya kurulu\u015flardan hizmet al\u0131nmas\u0131 durumunda \u00e7al\u0131\u015fanlara verilecek e\u011fitimin, y\u00f6netmelikte belirtilen hususlar\u0131 kapsayacak \u015fekilde uygulanmas\u0131ndan i\u015fveren sorumludur.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f g\u00fcvenli\u011finde e\u011fitimin ba\u015fl\u0131ca amac\u0131, \u00e7al\u0131\u015fanlar\u0131 korumak ve i\u015fyerinde i\u015fletme g\u00fcvenli\u011fini sa\u011flamakt\u0131r. Bu ama\u00e7la y\u00fcr\u00fcrl\u00fc\u011fe giren \u201c\u00c7al\u0131\u015fanlar\u0131n \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi E\u011fitimlerinin Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d h\u00fck\u00fcmleri uyar\u0131nca d\u00fczenlenecek e\u011fitimin amac\u0131, i\u015fyerlerinde sa\u011fl\u0131kl\u0131 ve g\u00fcvenli bir ortam\u0131 temin etmek, i\u015f kazalar\u0131n\u0131 ve meslek hastal\u0131klar\u0131n\u0131 azaltmak, \u00e7al\u0131\u015fanlar\u0131 yasal hak ve sorumluluklar\u0131 konusunda bilgilendirmek, onlar\u0131n kar\u015f\u0131 kar\u015f\u0131ya bulunduklar\u0131 mesleki riskler ile bu risklere kar\u015f\u0131 al\u0131nmas\u0131 gerekli tedbirleri \u00f6\u011fretmek ve i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi bilinci olu\u015fturarak uygun davran\u0131\u015f kazand\u0131rmakt\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>E\u011fitim programlar\u0131 \u00e7al\u0131\u015fana hangi aral\u0131klarda veriliyor?<\/strong><\/p>\n<p style=\"text-align: justify;\">E\u011fitim programlar\u0131n\u0131n d\u00fczenlenmesi hususunda i\u015fverenler, \u00e7al\u0131\u015fanlar\u0131n yapt\u0131\u011f\u0131 veya yapaca\u011f\u0131 i\u015fle ilgili bilgisinin olmamas\u0131, eksik olmas\u0131 ya da mevcut bilgisinin yetersiz kalmas\u0131 gibi hususlar\u0131 dikkate alarak i\u015fe ba\u015flamadan \u00f6nce, \u00e7al\u0131\u015fma yeri veya i\u015f de\u011fi\u015fikli\u011finde, i\u015f ekipmanlar\u0131n\u0131n de\u011fi\u015fmesi halinde ve yeni teknoloji uygulamalar\u0131nda, \u00e7al\u0131\u015fanlar\u0131n belirli e\u011fitim programlar\u0131ndan ge\u00e7melerini sa\u011flamakla y\u00fck\u00fcml\u00fc k\u0131l\u0131nm\u0131\u015flard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Y\u00f6netmelik \u00e7er\u00e7evesinde \u00fc\u00e7 de\u011fi\u015fik e\u011fitim program\u0131ndan bahsedilmektedir, bunlar\u0131 s\u0131ralayacak olursak;<\/p>\n<p style=\"text-align: justify;\">Yeni e\u011fitim; \u00e7al\u0131\u015fanlar\u0131n i\u015fe ba\u015flamalar\u0131nda ve yeni \u015fartlara kolayl\u0131kla uyum sa\u011flamalar\u0131 i\u00e7in yeni bilgiler vermek \u00fczere d\u00fczenlenen programlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130lave e\u011fitim; \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvenli\u011fi ve mesleki bilgilerinin eksikliklerini gidermek ve meslekteki niteliklerini geli\u015ftirmek i\u00e7in ilave bilgiler vermek \u00fczere d\u00fczenlenen prog- ramlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130leri e\u011fitim; \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvenli\u011fi ve mesleki d\u00fczeylerini y\u00fckseltmek ve meslekte eskimi\u015fli\u011fi gidermek i\u00e7in d\u00fczenlenen programlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">E\u011fitimler, de\u011fi\u015fen ve yeni ortaya \u00e7\u0131kan risklere uygun olarak yenilenmeli ve gerekti\u011finde periyodik olarak tekrarlanmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\"><strong>T\u00fcm \u00f6zel ve kamu kurulu\u015flar\u0131nda i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenlik e\u011fitimi zorunlu mudur?<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimi daha \u00f6nce de belirtti\u011fim \u00fczere 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 77\u2019inci maddesinde d\u00fczenlenmi\u015ftir. Kanun maddesinden de anla\u015f\u0131laca\u011f\u0131 \u00fczere i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimi; 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;na tabii olan i\u015fyerlerinde, 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nun kapsam\u0131nda \u00e7al\u0131\u015fan t\u00fcm i\u015f\u00e7ilerin bu e\u011fitimi almalar\u0131 gerekmektedir. Ancak 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nun, (Emekli Sand\u0131\u011f\u0131\u2019na tabi memurlar) \u00e7al\u0131\u015fanlar, (Ba\u011f- Kur\u2019a prim \u00f6deyenler) \u00e7al\u0131\u015fanlar\u0131n i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitimi almalar\u0131 ile ilgili bir zorunluluk bulunmamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitiminin konular\u0131 nelerdir?<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fverenler, \u00e7al\u0131\u015fanlar\u0131, yasal hak ve sorumluluklar\u0131 konusunda bilgilendirmek, onlar\u0131n kar\u015f\u0131 kar\u015f\u0131ya bulunduklar\u0131 mesleki riskler ve bunlarla ilgili al\u0131nmas\u0131 gerekli tedbirler konusunda i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi e\u011fitim programlar\u0131n\u0131 haz\u0131rlamak, e\u011fitimlerin d\u00fczenlenmesini, \u00e7al\u0131\u015fanlar\u0131n bu programlara kat\u0131lmas\u0131n\u0131 sa\u011flamak ve verilecek e\u011fitim i\u00e7in uygun yer, ara\u00e7 ve gere\u00e7 temin etmekle y\u00fck\u00fcml\u00fc k\u0131l\u0131nm\u0131\u015flard\u0131r. E\u011fitim programlar\u0131n\u0131n haz\u0131rlanmas\u0131nda i\u015f\u00e7ilerin veya sa\u011fl\u0131k ve g\u00fcvenlik i\u015f\u00e7i temsilcisinin kat\u0131l\u0131mlar\u0131 sa\u011flanarak g\u00f6r\u00fc\u015fleri al\u0131nmal\u0131d\u0131r. \u0130\u015fverenler genel e\u011fitim plan\u0131na uygun olarak y\u0131l i\u00e7inde d\u00fczenlenecek e\u011fitim faaliyetlerini g\u00f6sterir bir \u201cY\u0131ll\u0131k E\u011fitim Program\u0131\u201d da haz\u0131rlamak zorundad\u0131r. \u00c7al\u0131\u015fanlara verilecek e\u011fitim, y\u00f6netmelik gere\u011fince i\u015fyerinin faaliyet alan\u0131na g\u00f6re \u015fu ve benzeri konulardan se\u00e7ilmek zorundad\u0131r; Genel i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurallar\u0131, \u0130\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131n\u0131n sebepleri ve i\u015fyerindeki riskler, Kaza, yaralanma ve hastal\u0131ktan korunma pren- sipleri ve korunma tekniklerinin uygulanmas\u0131, \u0130\u015f ekipmanlar\u0131n\u0131n g\u00fcvenli kullan\u0131m\u0131, \u00c7al\u0131\u015fanlar\u0131n yasal hak ve sorumluluklar\u0131, Yasal mevzuat ile ilgili bilgiler, \u0130\u015fyerinde g\u00fcvenli ortam ve sistemleri kurma, Ki\u015fisel koruyucu alet kullan\u0131m\u0131, Ekranl\u0131 ekipmanlarla \u00e7al\u0131\u015fmas\u0131, Uyar\u0131 i\u015faretleri, Kimyasal, fiziksel ve biyolojik maddelerle ortaya \u00e7\u0131kan riskler, Temizlik ve d\u00fczen, Yang\u0131n olay\u0131 ve yang\u0131ndan korunma, Termal konfor \u015fartlar\u0131, Ergonomi, Elektrik, tehlikeleri, riskleri ve \u00f6nlemleri, \u0130lk yard\u0131m, kurtarma.<\/p>\n<p style=\"text-align: justify;\">Y\u0131ll\u0131k e\u011fitim program\u0131, y\u0131l i\u00e7inde e\u011fitim ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamak i\u00e7in d\u00fczenlenen genel bir \u00e7izelgedir. Bu \u00e7izelgede, verilecek e\u011fitimlerin hedefi, konusu, s\u00fcresi, amac\u0131, tarihi, e\u011fitim vereceklerin ad\u0131, soyad\u0131, unvan\u0131, e\u011fitime kat\u0131lanlar\u0131n say\u0131s\u0131 hakk\u0131nda bilgiler yer al\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>Avrupa \u00fclkelerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenlik e\u011fitimi nas\u0131l i\u015fliyor?<\/strong><\/p>\n<p style=\"text-align: justify;\">Avrupa Toplulu\u011fu i\u00e7inde yer alan \u00fclkelerce 1 Ocak 1993 tarihinden itibaren uygulanan \u201c\u00c7al\u0131\u015fanlar\u0131n Sa\u011fl\u0131k ve G\u00fcvenliklerini \u0130yile\u015ftirmeye Y\u00f6nelik Tedbirler Al\u0131nmas\u0131na \u0130li\u015fkin 89\/391 say\u0131l\u0131 \u00c7er\u00e7eve Y\u00f6nerge\u201d ile i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunda uygulanmas\u0131 gereken genel kurallar a\u00e7\u0131klanm\u0131\u015ft\u0131r. Y\u00f6nerge i\u00e7inde yer alan prensiplerin kabul\u00fc ile Avrupa Birli\u011fi\u2019ndeki t\u00fcm \u00fclkelerde bu sisteme paralel bir i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi sisteminin olu\u015fturulmas\u0131 ve \u00e7al\u0131\u015fanlar\u0131n e\u011fitilmesi zorunludur.<\/p>\n<p style=\"text-align: justify;\">Y\u00f6nerge birka\u00e7 istisna d\u0131\u015f\u0131nda b\u00fct\u00fcn i\u015f dallar\u0131nda i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi konusunda geli\u015fmeyi hedeflemi\u015ftir.
